Have you heard about the AI Disclosure Act of 2023?
The Act was introduced this summer in Congress to try to address issues of AI transparency and accountability. It requires any content created from generative AI to carry a disclaimer stating: “Disclaimer: this output has been generated by artificial intelligence” in order to inform users that what they are engaging with is a product of AI rather than human creation. Further, the Act would characterize non-compliance with the disclosure requirement as “unfair or deceptive acts or practices” under the Federal Trade Commission (FTC) Act.
However, what is even more interesting is the failure of the Act to address the more complex situations of content co-created by both generative AI and human input which will most likely make up the bulk of AI-generated content released. Such failure will make the legislation not clearly applicable to the real world.
